1. About these terms

This website is operated by Global Impact Enterprises, LLC, trading as NPRWLR ("NPRWLR", "we", "us", "our"). These Terms of Service govern your access to and use of www.nprwlr.com (the "Site") and any purchase you make from us. By visiting the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site.

Our Privacy Policy, Shipping Policy, and Refund Policy are incorporated into these terms by reference.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Products, descriptions and pricing

We make every effort to display our products and their colours accurately. Screens vary, and we cannot guarantee that the colour you see is an exact match for the finished garment. Product measurements are provided on each product page; small variations are normal in manufactured apparel.

All prices are shown in US dollars and are subject to change without notice. Prices exclude shipping, duties, and taxes unless clearly stated otherwise.

Despite our efforts, product or pricing information on the Site may occasionally contain errors. We reserve the right to correct any error and to cancel any order placed on incorrect information, even after the order has been submitted and payment taken. If we cancel your order for this reason, we will notify you and issue a full refund.

4. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt of that offer but does not constitute acceptance. A contract is formed only when we dispatch your order or notify you that production has begun.

We reserve the right to refuse or limit any order, including orders that appear to be placed by dealers or resellers, orders that appear fraudulent, and orders that exceed reasonable quantities.

Products are made to order and production begins shortly after checkout. Cancellation is only possible before production starts. See our Refund Policy.

5. Payment

Payment is taken at checkout through Shopify's secure payment processing. By submitting payment information, you confirm you are authorised to use the payment method and that the details you provide are true and complete. We do not store full payment card numbers.

Applicable sales tax and, where relevant, duties are calculated at checkout or on delivery, as described in our Shipping Policy.

6. Shipping, risk and title

Shipping timeframes, delivery estimates, duties, and our commitments in the event of delay are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you on delivery of the goods to the carrier, without affecting the claims process described in our Shipping and Refund Policies.

7. Returns and refunds

Our Refund Policy sets out what we replace or refund and how to make a claim, including the 30-day window for damaged, defective, misprinted, or incorrect items, and the statutory cancellation rights that apply to orders shipped to the EEA and the UK. Nothing in these terms limits rights that applicable consumer law gives you and that cannot be excluded.

8. Intellectual property

The Site and all content on it — including the NPRWLR name and marks, the "Rise When No One Else Will" line, logos, artwork, garment graphics, photography, text, and layout — are owned by us or our licensors and are protected by intellectual property laws.

You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, distribute, sell, or create derivative works from our designs or content, or reproduce our designs on merchandise, without our prior written permission.

9. Content you submit

If you submit reviews, photographs, comments, or other content to us or tag us on social media, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, and display that content in connection with our business, including in marketing. You confirm that you own the content or have the right to grant this licence, and that it does not infringe anyone else's rights.

We may remove or decline to publish any submitted content at our discretion. We are under no obligation to keep submissions confidential or to pay compensation for them.

10. Acceptable use

You agree not to use the Site to break any law; to infringe anyone's intellectual property; to submit false or misleading information; to upload malicious code; to collect or track the personal information of others; to interfere with the security features of the Site; or to scrape, spider, or otherwise harvest content from the Site by automated means without our permission. We may terminate your access for breach of this section.

11. Third-party links and services

The Site may link to third-party sites, tools, and services that we do not control. We are not responsible for their content, accuracy, or practices, and their inclusion does not imply endorsement. Any dealings with third parties are between you and them.

12. Disclaimers

Except as expressly stated in these terms and except for rights that cannot be excluded under applicable consumer law, the Site and our products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

NPRWLR apparel is clothing. Product names, graphics, and collection names — including those drawn from Scripture — are expressive and symbolic. No garment is represented as providing physical, spiritual, or protective benefit of any kind.

13. Limitation of liability

To the fullest extent permitted by law, NPRWLR, its officers, members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of the Site or any product purchased from us.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to your use of the Site or any product will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold harmless Global Impact Enterprises, LLC and its officers, members, and employees from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

15. Governing law and disputes

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over any dispute arising out of these terms, except where applicable consumer law in your country of residence gives you the right to bring proceedings in your local courts, in which case that right is preserved.

16. Severability and waiver

If any provision of these terms is found unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.

17. Changes to these terms

We may update these terms at any time by posting a revised version on this page. The "last updated" date shows when they last changed. Your continued use of the Site after a change constitutes acceptance of the revised terms. Orders are governed by the terms in force at the time the order is placed.

18. Entire agreement

These terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements or understandings.
